Terms and Conditions

All clients and models should read this carefully before booking a model,or accepting work from Impact Model Agency
  1. Terms and conditions
    The terms and conditions set out below are for the mutual benefit of Clients /Photographers, Agent and Models. It is suggested that all clients read and agree by these terms and conditions prior to making a booking with Impact Model Agency.
  2. Permitted use
    Booking fees cover the right to use images for a period determined at the time of booking and not exceeding one year from the date of the booking. Any further usage should be negotiated and agreed in advance with Impact Model Agency.
  3. Our rates
    Booking fees are charged by the day or half day. Additional hourly rates may apply.
  4. Overtime
    Overtime rates apply before 9am and after 6pm and on all bookings over 8 hours. Overtime is charged at one and a half times the normal rate.
  5. Travel
    Will be charged at 40 pence per mile.
  6. Fitting fees

    Model fitting fees are negotiated with the agency.

  7. Additional fees
    To be agreed with client and agent at the time of the booking.
  8. Fees negotiated
    The fee negotiated by the agent and the client is the model’s fee from which agency commission will be deducted. Expenses will be added where appropriate.
  9. Invoicing
    On all invoices payment is required within 30 days of date of invoice. Overdue payments will incur an additional 10% service charge over and above the total invoice cost. The person booking the model is the client who will be invoiced and solely responsible for payment, unless otherwise agreed in writing at the time of booking. All fees for usage are for the right to use the model’s image and, once agreed, are payable whether or not the image is used. Unless the agent specifically agrees otherwise, in writing, no usage for the model’s image is permitted until payment is made in full. The agency reserves the right to alter payment terms if deemed appropriate prior to booking.
  10. Employment Status / Income Tax
    Models signed to Impact Model Agency work on a ‘self employed’ basis. All payments made are gross of income tax. It is therefore the responsibility of all Impact models to personally declare any money earned whilst working for or on behalf of Impact Model Agency, to the Inland Revenue
  11. Provisional Bookings
    Provisional bookings will be automatically cancelled if they are not confirmed within 24 hours of the proposed booking, or if a definite booking is offered and the provisional booking has not been confirmed.
  12. Cancellations
    If a booking is cancelled within one working day of the starting time, the full booking fee will be charged unless the same model is re-booked within 24 hours. If a booking is cancelled outside the one day period but within two working days of the starting time then half the booking fee will be charged. Bookings of more than three days duration – If the booking is cancelled within a period equal to the length of the booking, the full fee is charged. This arrangement is reciprocal between model and client.
  13. Weather permitting bookings
    Weather permitting bookings should be discussed between client and agent however, the full booking fee is charged if the booking is not cancelled with 24 hours notice.
  14. Meals and refreshments
    Clients are responsible for models’ refreshments/meals on all bookings over 4 hours.
  15. Fashion shows
    Catwalk bookings give the right to make use of a model’s services on the catwalk for the specified show, and the right to allow photographers to be present to take photographs and videos of the show on the understanding that all such material is for reporting purposes only. If any other usage is required this must be negotiated with the agent at the time of booking.
  16. T.V. Work, Commercials, Music videos
    All fees will be negotiated individually, including usage rights.
  17. Test and experimental photography
    Photographers are not entitled to take test / experimental photographs to use for their own commercial purposes or resale.
  18. Copyright
    The photographer and/or the client is not entitled to use any images for any usage beyond that agreed at time of booking. A Model Release form should be supplied by the photographer and signed by the model giving permission for use of images for a specific purpose. The photographer/client to this extent, agree to restrict use and exploitation of the copyright. If the client is not the photographer, the client should draw to the attention of the photographer our terms and conditions and obtain his agreement to them before the shoot commences.
  19. Confidentiality
    It is the responsibility of the client to ensure that all persons (i.e. models, artists, photographers, stylists, directors and crew) attending a photographic, filming or other event will keep confidential all private and/or commercially sensitive information disclosed to them by any means during or as a result of their attendance at the session.
  20. Insurance
    (a) It is the client’s responsibility to carry out a proper risk assessment of the location, equipment and work conditions. Any risk to Health & Safety known to the client must be discussed with the agent at the time of booking. The client is responsible for the model’s health and safety when the model is providing services in connection with the booking. The client is obliged to make sure that all other people engaged in connection with the booking and associated travel are properly qualified and insured. The client must maintain adequate insurance cover to underwrite its obligation to the model.
    (b) The agent is not responsible if the model fails to attend a booking. The client is advised to insure against any losses which might be suffered if the model does not keep a booking because of ill health or some other reason.
  21. Responsibility for personal possessions.
    All props, clothes, mobile phones, and any other possessions taken to a photo shoot or on location are the sole responsibility of the model. Impact Model Agency and Impact’s Clients cannot be held responsible for any loss or damage.
  22. Consent
    By agreeing to attend a model / video shoot organised through Impact Model Agency verbal consent is implied. Models or guardians if model is under 18 years therefore accept client / photographers full rights to use any resulting images.
  23. Contract
    All matters relating to the use of the model’s image, other services supplied by the model and all fees must be negotiated and agreed only with the agent – Impact Model Agency. Verbal and private booking agreements should not be conducted between client and models from Impact Model Agency without agreement from the agent.
  24. Complaints
    Any cause for complaint should be reported when it arises. Complaints cannot be considered in retrospect.

Please note.
These terms and conditions take precedence over any other terms and conditions which may be received from the client, even if those terms and conditions have a similar clause. Photographs may not be used until all fees are paid in full. We strive to provide a satisfactory and efficient service to our clients but, as the agent, we cannot be held responsible for a model’s conduct on any assignment. The agent reserves the right to negotiate within the structure of these terms and conditions.
